For contracts signed prior to engaging McDonald Legal, we prepare advice on the signed contract of sale which includes but is not limited to

  • Explanation on the terms of the contract;
  • Explanation of the purchasers responsibilities and vendors responsibility under the contract
  • Completing relevant property searches including one title search, registered plan, land information certificate, water information certificate, sro land tax certificate and owners corporation certificate (if relevant);
  • Review of section 27 statement and facilitation of signing if request by the vendor;
  • Preparation and drafting of the transfer of land and electronically signing on your behalf;
  • Preparation and cheque directions for capital gains withholding and or gst withholding if required;
  • Liaising with the purchase and/or the financier to arrange for the preparation of settlement funds at settlement if relevant;
  • Preparation and drafting of statement of adjustments and settlement statement for approval from the vendor.;
  • Book electronic settlement with the relevant parties;
  • Complete settlement preparation steps prior to settlement such as providing your cheque directions to the vendor and providing settlement figure to your financier if applicable;
  • Notify authorities of the purchase of the property and issue the notice of acquisition.

For sellers of property

For individuals and organisations engaging mcdonald legal for the conveyance of a property for sale, McDonald Legal provide the following services;

  • Completing relevant property searches including one title search, registered plan, land information certificate, water information certificate, planning and bushfire certificate, sro land tax certificate, vicroads certificate, epa certificate and one owners corporation certificate (if relevant);
  • Preparation of the contract of sale and vendor’s statement (section 32) and issuing to the real estate agent;
  • Preparation of section 27 statement (early release of deposit) and obtaining details from the mortgagee on title to complete section 27 statement and forwarding to you and the purchaser to sign if requested;
  • Review of the transfer of land drafted and electronically signed by the purchaser solicitor and providing same signed on your behalf;
  • Preparation of capital gains withholding statement and gst withholding statement for the purchaser;
  • Liaising with the financier to arrange for the discharge of the mortgage at settlement if relevant;
  • Review statement of adjustments and settlement statement received from the purchaser;
  • Book electronic settlement with the relevant parties;
  • Complete settlement preparation steps prior to settlement such as providing your cheque directions to the purchaser and checking the payout figure from your financier if applicable;
  • Notify authorities of your sale of the property and issue the notice of disposition.
