: The essential SMSF documents
Trust Deed Outlines the basis under which the SMSF can operate.
Trustee Resolution to establish the SMSF Documents the trustees’ agreement to establish the SMSF and adopt the Trust Deed.
Australian Taxation Office (ATO) Trustee Declaration Confirms that as a trustee, or director of the corporate trustee, you are aware of your duties and responsibilities in relation to the operation of your SMSF.
Consent to Appointment as Trustee/Director of a Corporate Trustee Confirms that each Trustee/Director consents to act as trustee, or director of the corporate trustee of your fund and that you are not disqualified from acting in this capacity.
Investment Strategy Template Provided to you to document your SMSF’s investment strategy and fulfil your trustee obligation to maintain a relevant Investment Strategy.
Letter of Comfort A letter from McDonald Legal confirming that your Trust Deed complies with superannuation law at date of issue.
Product Disclosure Statement (PDS) The PDS outlines the key features, benefits and risks in respect of you SMSF and needs to be retained for your records.
Membership Application Needs to be completed by each member joining your SMSF.
 : Trustee Company Documentation (if required)
Company Constitution Outlines the basis under which the company will operate and needs to be reviewed by each Director to confirm appropriateness for the corporate trustee of your SMSF.
Certificate of Registration of a Company Issued by ASIC, the Certificate of Registration of a Company is a certificate of your trustee company registration.
Company Forms The various forms your Trustee Company will require, including: • Director Appointment Consent • Member Consent and Share Application • Occupier Consent (if applicable) • Proposed Director Acknowledgement • Secretary Appointment Consent.
Your SMSF cash account
McDonald Legal will apply to open a Macquarie Cash Management Account on behalf of your SMSF. Contributions, rollovers and investment income can be deposited into your SMSF’s cash account, while asset purchases, insurance premiums, pension payments and all other outgoings can be paid from your SMSF’s cash account.
 : Registration of your SMSF
Once all the necessary documentation has been prepared and signed, we will apply for your SMSF’s:
SMSF’s Tax File Number (TFN)
Australian Business Number (ABN)
Registration as a regulated SMSF with the ATO.
